The National Summit on Legal Preparedness for Obesity Prevention and Control was conceived by the Centers for Disease Control and Prevention as a strategic conference to review the current status of legal preparedness for obesity prevention and control, identify potential gaps, and develop specific action options for improving the contribution law can make to reduce the health threat posed by obesity. Working with the collaborating partners and planning committe, the host committe planned and modeled after the Summit CDC’s 2007 conference (...) on public health emergency legal preparedness that resulted in the National Action Agenda for Public Health Emergency Legal Preparedness. The summit was a working meeting that offered invited participants a structured opportunity to deliberate about the laws and legal issues that impact obesity prevention and control from a public health perspective. A genomic diagnosis for a young child could guide access to developmental care, school services, and social supports; yet these contexts remain understudied. Here we describe (at least) two ways a genomic diagnosis could promote such utility: as a ticket, where the diagnosis qualifies a child for services they weren’t previously able to access, or as a roadmap, where the diagnosis guides which services might be helpful. We explore the implications of a diagnosis that functions as either a ticket or (...) a roadmap, including how either might create additional disparities in the US developmental services system. We argue that fewer inequities would exist in a world where a genomic diagnosis functions more as a roadmap than a ticket. We recommend policy changes (increase early intervention funding, improve family navigation, and incentivize developmental services research) that can avoid the inequities associated with the “ticket” and move us towards a “roadmap” future. In "Frailty Triage: Is Rationing Intensive Medical Treatment on the Grounds of Frailty Ethical?," Wilkinson (2021) argues that the use of frailty scores in ICU triage does not necessarily involve discrimination on the basis of disability. In support of this argument, he claims, “it is not the disability per se that the score is measuring – rather it is the underlying physiological and physical vulnerability." While we appreciate the attention Wilkinson explicitly pays to disability in this piece, we find the (...) distinction between disability and underlying vulnerability untenable both theoretically and practically. In this peer commentary, we begin with a brief overview of research in philosophy of disability concerning the meaning of the concept itself. We argue that this research demonstrates that many forms of disability do not involve underlying vulnerabilities, and, furthermore, that Wilkinson equivocates between "disability" understood as a medical category vs. "disability" understood as a feature of lived experience. We reject Wilkinson’s distinction on these grounds and offer further considerations to avoid disability discrimination in emergency and crisis standards of care contexts. (shrink)

The literature contains many recommendations, both explicit and implicit, that suggest how an ethics program ought to be designed.While we recognize the contributions of these works, we also note that these recommendations are typically based on either social scientific theory or data and as a result they tend to discount the moral aspects of ethics programs. To contrast and complement these approaches, we refer to a theory of the right to identify the characteristics of an effective ethics program. We draw (...) from Kant’s ethical theory to identify three guiding principles of a moral ethics program and then apply those principles to the specific components of ethics programs as discussed in the Federal Sentencing Guidelines. Doing so provides insights as to how an ethics program ought to be designed from a moral point of view and sparks discussion of the moral aspects of ethics programs. (shrink)

Theravāda Buddhists draw a doctrinal distinction between otherworldly (lokuttara) and this-worldly (lokiya) actions, and also an ecclesiastical distinction between bhikkhu (wandering mendicant or 4 "monastic") action and lay action. Within the Theravāda tradition these modes of action have overlapped to form a more empirically relevant set. This set is constituted by the otherworldly action of the path winning bhikkhus, the this-worldly action of ordinary bhikkhus, the path winning or bodhisatta (future Buddha) action of exceptional laymen, and the this-worldly action of (...) ordinary laymen. These four modes of action have meshed together to form the basis for very complex and persistent Theravāda societies in Sri Lanka and Southeast Asia. The article concludes with some methodological observations concerning the relationship between the study of action (as carried out in the body of the article), and the study of ethics (as carried out by most contemporary scholars in the field of religious ethics).
