Correspondence and texts by Fichte and Schelling illuminate their thought and the trajectory of their philosophical falling out.

Noncompete agreements are among the most commonly used methods to restrict employment. Upwards of 38% of American workers, many of which are low-wage workers, have signed noncompete agreements. These agreements effectively hold those workers hostage to their current employer. This project analyzes the use of noncompete clauses in employment contracts with low-wage workers. We show that noncompetes with low-wage workers are not enforceable in the U.S.; employers nevertheless continue to include noncompete clauses in employment contracts with low-wage workers. We survey (...) states’ attempts to regulate the use of (even unenforceable) noncompetes and argue that current legislation is ineffective at preventing employers from including noncompetes in low-wage worker contracts. We argue that employers’ use of (even unenforceable) noncompete agreements with low-wage workers is wrongfully exploitative of those workers, and we provide suggestions for how states can effectively regulate the use of noncompetes, and thus protect low-wage workers from exploitation, using Virginia’s recently passed noncompete bill as a model. Owen Ware here develops and defends a novel interpretation of Fichte’s moral philosophy as an ethics of wholeness. While virtually forgotten for most of the twentieth century, Fichte’s System of Ethics is now recognized by scholars as a masterpiece in the history of post-Kantian thought and a key text for understanding the work of later German idealist thinkers. This book provides a careful examination of the intellectual context in which Fichte’s moral philosophy evolved and of the specific (...) arguments he offers in response to Kant and his immediate successors. A distinctive feature of this study is a focus on the foundational concepts of Fichte’s ethics—freedom, morality, feeling, conscience, community—and their connection to his innovative but largely misunderstood theory of drives. By way of conclusion, the book shows that what appears to be two conflicting commitments in Fichte’s ethics—a commitment to the feelings of one's conscience and a commitment to engage in open dialogue with others—are two aspects of his theory of moral perfection. The result is a sharp understanding of Fichte's System of Ethics as offering a compelling resolution to the personal and interpersonal dimensions of moral life. (shrink)

The article explores different ways in which the term ‘metaphilosophy’ or ‘philosophy of philosophy’ can be applied in the context of Fichte’s Wissenschaftslehre. It is argued that despite the terminological differences partially caused by Fichte’s renaming of philosophy and the unclear meaning of ‘metaphilosophy,’ several options are available. The article suggests considering metaphilosophy as one of the many ‘meta-constructions’—such as the thinking of thinking, philosophizing about the philosophizing, and the metaphysics of metaphysics—that can be found throughout the history (...) of philosophy and in Fichte’s thought. They follow the figure of self-application, which is compatible with historical and contemporary translations of ‘meta’ as after, beyond, and about. The available options are the Wissenschaftslehre of philosophy, understood as the revision of philosophy and thematization of deficient or incomplete conceptions of philosophy from the standpoint of the Wissenschaftslehre; the Wissenschaftslehre of the Wissenschaftslehre as the propaedeutic self-reflection, successive reformulation, and picture that emerges with the completion of the system; and philosophy of the Wissenschaftslehre. The latter, the external view of Wissenschaftslehre as one philosophy among others, is almost not present in Fichte. However, it connects Fichte’s Wissenschaftslehre with contemporary metaphilosophy, as demonstrated by Rescher’s topics, benefiting both Fichte scholars and contemporary metaphilosophers. (shrink)

There is no question that Fichte's theory of conscience is central to his system of ethics. Yet his descriptions of its role in practical deliberation appear inconsistent, if not contradictory. Many scholars have claimed that for Fichte conscience plays a material role by providing the content of our moral obligations—the Material Function View. Some have denied this, however, claiming that conscience only plays a formal role by testing our moral convictions in any given case—the Formal Function View. My (...) aim in this paper is to offer a new contribution to this debate. I begin by supplying further evidence in support of the view that conscience only plays a formal function in Fichte's ethics. Then I call attention to a deeper problem this view faces, namely, that it invites an infinite regress by making one's conviction a matter of higher-order reflection. The key to overcoming this threat, I argue, lies in Fichte's doctrine of feeling, whereby the criterion of one's conviction lies, not in a cognitive state, but in an affective state. In closing, I discuss the relevance of Fichte's theory for current debates over the nature of moral error and moral deference. (shrink)

Fichte is the first great Post-Kantian Idealist and his debt to Spinozism has been acknowledged by virtually all of his commentators. However, the extent of Spinoza’s influence on Fichte has not been spelled out in much detail. In response to this I propose to do two things. Firstly, I propose to provide a typology of interpretations of Fichte’s Absolute I, as some commentators seem to get entangled in these different interpretations, which can be very confusing to their (...) readership. Fichte's philosophy represented one of the first coherent attempts to provide a utopian philosophical foundation for preventative police power, one which anticipated in surprising ways the fundamental logical premises of modern dataveillance or "datapower." This article examines Fichte's proposals for a new system of police passports and the logic of control on which it rests, contextualizing it within the transformation of police practices during his lifetime. “I am only what I make myself to be”, Fichte tells us. In this paper, I outline Fichte’s views on sex, marriage and gender, with two aims. Firstly, to elucidate an aspect of his moral theory which has received little attention, and secondly to argue that Fichte’s distinctive stance on selfhood, freedom, and normativity lead to a revisionary account of gender expression and identity, where people can freely carve out their own identity, irrespective of “nature”. In this (...) paper, I therefore outline Fichte’s own views, highlighting what I see as a tension in the texts between essentialism and antiessentialism about gender, before reconstructing a neo-Fichtean view which foregrounds the anti-essentialist aspect. The main claim in this essay is that there is another vital but overlooked religious meaning and tradition of Tathandlung with which the idealistic philosopher J.G. Fichte engages, in addition to the legalistic tradition of Tathandlung that so far has been the sole tradition noted in Fichte scholarship. Crucially, it is precisely this other neglected religious tradition that especially becomes philosophically transformed by Fichte in his central work of the Jena period, the Foundation of the Entire Wissenschaftslehre (...) It is often assumed that Fichte's aim in Part I of the System of Ethics is to provide a deduction of the moral law, the very thing that Kant – after years of unsuccessful attempts – deemed impossible. On this familiar reading, what Kant eventually viewed as an underivable 'fact' (Factum), the authority of the moral law, is what Fichte traces to its highest ground in what he calls the principle of the 'I'. However, scholars have largely overlooked (...) a passage in the System of Ethics where Fichte explicitly invokes Kant's doctrine of the fact of reason with approval, claiming that consciousness of the moral law grounds our belief in freedom (GA I/5:65). On the reading I defend, Fichte's invocation of the Factum is consistent with the structure of Part I when we distinguish (a) the feeling of moral compulsion from (b) the moral law itself. (shrink)

This article presents a new interpretation of the notorious "Horen" dispute between Schiller and Fichte by examining the text that was the catalyst for it, Fichte’s "On Spirit and Letter in Philosophy" (1795-1800), from the overlooked perspective of Schiller’s 1793 essay "On Grace and Dignity". It demonstrates that the Horen dispute is based on a theoretical misunderstanding rather than an irreconcilable opposition, arguing that Schiller’s notion of grace as beauty in movement provides the idealism and aesthetics of (...) class='Hi'>Fichte’s Wissenschaftslehre with a powerful conceptual tool that was lacking in Kant’s critical philosophy. In this paper, I offer a novel reading of how Fichte’s contemporaries shaped the development of his account of free will. Focusing on his emerging views in the second edition of _Revelation_ and the Creuzer review, I argue that Fichte’s position is closer to Reinhold’s than previously recognized. In particular, I demonstrate Reinhold’s decisive influence on the development of a key aspect of Fichte’s mature, genetic account of freedom: the transition from indeterminacy to determinacy.

Von ihren frühen Anfängen in Jena bis zum Berliner Spätwerk steht Johann Gottlieb Fichtes Philosophie theoretisch gleichermaßen wie praktisch im Zeichen der Revolution: Ebenso wie das von Fichte in immer wieder neuen Ansätzen verfolgte Projekt der Wissenschaftslehre seinen Ausgang von Kants transzendentaler Revolution der Denkart nimmt und diese auf alle ihre Prinzipien und Konsequenzen hin vertieft und weiterführt, artikuliert dieses Projekt das Selbstbewusstsein des in seiner universellen politischen und geschichtsphilosophischen Tragweite für den modernen Anspruch auf Emanzipation paradigmatischen Ereignisses der (...) Die transzendentalphilosophische Theorie Johann Gottlieb Fichtes bietet eine Konzeption, mittels derer sich strukturelle bzw. methodologische Schwierigkeiten einer philosophischen Theoriebildung über das empirische Bewusstsein nicht nur vermeiden, sondern produktiv instrumentalisieren lassen. Um der gegenwärtig naturalistisch geprägten Bewusstseinsphilosophie einen logisch-begrifflich bzw. apriorisch fundierten Ansatz gegenüberzustellen, stehen im folgenden einzelne Theoriestücke des Fichteschen Systems zentral, die der besonderen Struktur des empirischen Bewusstseins gerecht werden können.

This article argues against the dominant Anglophone and Francophone interpretation of Fichte, which reads him as advancing either a form of ethnic or cultural nationalism. It claims that what is missing from the current reception of Fichte is the essentially philosophical and cosmopolitan character of his nationalism – the fact that the Addresses to the German Nation uses non‐empirical and cosmopolitical concepts to develop and articulate its nationalistic viewpoint. It therefore claims that the notion of a national philosophical (...) idiom that the Addresses present, far from being a screen for its nationalism, is its driving engine. It does this by considering the problems of translating the German locution ist unsers Geschlechts. Consequently, it is claimed that the cosmo‐nationalism of Fichte is not reducible to a set of claims regarding ethnicity or even the empirical world, even if a discourse on the organismic, on what counts as life, irreducibly haunts the Addresses. A precursor to the hard problem of consciousness confronts nihilism. Like physicalism, nihilism collides with the first-personal fact of what perception and action are like. Unless this problem is solved, nature’s inclusion of conscious experience will remain, as Chalmers warns the physicalist, an “unanswered question” and, as Jacobi chides the nihilist, “completely inexplicable". One advantage of Kant’s Copernican turn is to dismiss the question that imposes this hard problem. We need not ask how nature is accompanied by the first-person standpoint (...) because “I think” is an apperceptive form of thinking that must be able to accompany any cognition of nature. Kant’s formal conception of apperception worries Fichte in his Nova Methodo lectures. This conception arguably cannot exhaust the ground of experience, for it does not show why we posit objects “at all". For Fichte, it is our agency that first opens a world of objects, viz., as subjects, means, ends, and obstacles. In what follows, I argue that, for Fichte, the I poses no hard problem because it collides exclusively with nihilistic views like Spinozism, which are refuted by a properly transcendental idealist conception of apperception, according to which the first-person standpoint is the absolute ground of our experience of nature. If transcendental idealism refutes nihilism, nature is no more explicable than that there is something it is like for me to perceive and act. In Section 1, I show why Kantian apperception is necessary for possible experience. In Section 2, I reconstruct Fichte’s argument that a modified conception of apperception refutes guises of nihilism, thereby solving the hard problem of consciousness. In Section 3, I suggest that transcendental idealism undermines Chalmers’ proposed solution to and Dennett’s dismissal of this problem. (shrink)

Cet article montre que Fichte développe une originelle conception du langage dans ses Discours à la Nation allemande d’où il ressort non seulement le besoin de retraduire des concepts philosophiques dans un langage populaire comme aussi celui de formuler un langage plus malléable pour la philosophie en tant que telle. This paper proposes a new perspective on the entanglement of antisemitism and philosophy by exploring the function and persistence of a cliché in philosophical discourse. It begins with an analysis of Immanuel Kant’s remarks on “the Jews in Poland” in a passage often regarded as his most anti-Jewish statement. These remarks are contextualized within the framework of Kant’s Anthropology and the late 18th-century debates on Jewish emancipation. The paper then turns to contemporary philosophical discussions on Johann Gottlieb Fichte’s anti-Jewish (...) polemics in which the trope of “the Jews in Poland” reappears, showing the enduring influence of the cliché. Abstract: In recent work Stephen Darwall has attacked what he calls J. G. Fichte's ‘voluntarist’ thesis, the idea—on Darwall's reading—that I am bound by obligations of respect to another person by virtue of my choice to interact with him. Darwall argues that voluntary choice is incompatible with the normative force behind the concept of a person, which demands my respect non-voluntarily. He in turn defends a ‘presuppositional’ thesis which claims that I am bound by obligations of respect simply by (...) recognizing the other as a person. In this paper I argue Darwall has misidentified the voluntary element in Fichte's account (sections 4–5). This requires me first to explain what Fichte's voluntarism really consists in (sections 1–3), and I suggest an apparent ambiguity in Fichte's position is responsible for Darwall's misreading. Clarifying this ambiguity, however, exposes some limitations to Darwall's thesis, and I end by discussing what those limitations are and what we can learn from them (sections 6–8). (shrink)

This paper addresses Fichte’s puzzle of self-consciousness. I propose a new reading of “Fichte’s original insight,” inspired by Pareyson’s general reading, which I call here the “Fichtean metaphysical turn in transcendental philosophy.” Against the mainstream view in Fichte’s scholarship, I argue that Fichte’s and Kant’s views do not concur regard- ing the primary reference of the “I”, namely spontaneous agency in thinking, which Fichte calls “Tathandlung”. Yet, their views do, in fact, concur when Fichte (...) claims that this spontaneous agency in thinking is the “essence” or the underlying nature of the self, which Kant denies. Regarding this, I take the side of Fichte. But how is Fichte’s original insight supposed to solve the puzzle of self-consciousness? At that transcendental level, the puzzle does not arise because there is no need for self-identification in the first place. Transcendental self-knowledge results from the sui generis intellectual Selbstanschauung that everyone has of oneself as sheer spontaneous agency in thinking. But at the empirical level, the puzzle does not arise either and for the same reason. Reference to the embodied self dispenses with any self-identification because it is based on the fundamental metaphysical relation everybody has to their own body, namely identity. (shrink)

A pesar de que René Girard se ha expresado duramente en contra de la filosofía y, especialmente, del llamado «idealismo alemán», en los últimos años hubo interpretaciones de su obra en conexión con la filosofía clásica alemana. Proponemos aquí una lectura de la teoría mimética girardiana en conjunción con la filosofía de Johann Gottlieb Fichte, cosa que, hasta donde sabemos, no ha sido ensayada. La dimensión que opera como punto de partida para tal lectura conjunta es la religiosa. A (...) partir de allí, podremos destacar similitudes estructurales entre el primer principio de la filosofía de Fichte (el Yo=Yo) y la teoría mimética y, a la vez, mostrar la diferente cristología en juego en ambos autores. Creemos que el acercamiento entre la doctrina de la ciencia fichteana y la teoría mimética girardiana puede ser provechoso para ambas perspectivas. Although René Girard has harshly opposed philosophy and especially so-called «German idealism», in recent years there have been interpretations of his work in connection with classical German philosophy. We propose here a reading of Girardian mimetic theory in conjunction with the philosophy of Johann Gottlieb Fichte, an approach that, as far as we know, has not been tried. The dimension that works as a starting point for such a combined reading is the religious dimension. From there, we will be able to highlight structural similarities between the first principle of Fichte's philosophy (the I=I) and the mimetic crisis and, at the same time, to show the different Christology at play in both authors. We believe that the rapprochement between the Fichtean doctrine of science and Girardian mimetic theory can be fruitful for both perspectives. (shrink)

Levinas never engaged closely with Fichte’s work, but there are two places in the chapter “Substitution,” in Otherwise than Being (1974), where he mentions Fichte by name. The point that Levinas underscores in both of these passages is that the other’s encounter with the subject is not the outcome of the subject’s freedom; it is not posited by the subject, as Fichte has it, but is prior to any free activity. The aim of this paper is to (...) deepen the comparison between Levinas and Fichte, giving special attention to Fichte's own novel theory of intersubjectivity and the summons. One result that emerges from this treatment is that both Levinas and Fichte view the second person in a way that has no equivalent in the current philosophical landscape. On this reading, each thinker views responsibility to the other, not only as an immediate and particular obligation, but also as an asymmetrical relation that gives the other moral priority. Fichte assigns ‘intellectual intuition’ a new meaning after Kant. But in 1799, his doctrine of intellectual intuition is publicly deemed indefensible by Kant and nihilistic by Jacobi. I propose to defend Fichte’s doctrine against these charges, leaving aside whether it captures what he calls the ‘spirit’ of transcendental idealism. I do so by articulating three problems that motivate Fichte’s redirection of intellectual intuition from being to acting: (1) the regress problem, which states that reflecting on empirical facts (...) of consciousness leads only to further facts and so cannot yield a first principle; (2) the rhapsody problem, which states that the categories form a haphazard set and so lack necessity unless they derive from a first principle; and (3) the nihilism problem, which states that a first principle cannot lie outside our cognition of it, lest it be the cause of our cognition and, being first, the cause of all our actions, reducing us to machines. Crucially, Fichte’s three motivating problems are in fact aspects of a single problem. Leaving any aspect unsolved spoils putative solutions to the other two. Consequently, Fichte requires a single unified solution to all three, which his doctrine of intellectual intuition provides. (shrink)

Kant and Fichte developed the concept of a worldview as a way of reflecting on experience as a whole. But what does it mean to form a worldview? And what role did it play in the German Idealist tradition? This paper seeks to answer these questions through a detailed analysis of the form of a philosophical worldview and its historical portent, both of which remain unexplored in the literature. The dearth of attention is partially to blame on Kant’s desultory (...) development of it, as well as its place in Fichte’s understudied lectures on religion. In this paper, I first reconstruct Kant’s conception as the starting point and then trace it to Fichte who went on to evolve it further. Fichte endorses the basic conceptual shape pioneered by Kant, namely, a reflective process of positing an idea and then checking the coherence of necessary judgments relative to it. However, Fichte came to realize that its philosophical function needed expanding. Beyond recognizing the possibility for alternative worldviews, Fichte further fleshed out how worldview creation could lead to human flourishing. The common feature between both thinkers is that the formation of a worldview aims to turn philosophy into a life-orienting exercise. (shrink)

En tercer lugar, será tematizado el sentido del logos expuesto en la Introducción y la División General de la Ciencia de la lógica de Hegel. How surprising is the insight, that being equals I in the 15th lecture of the Doctrine of Science 1804/II? It might have been indeed an unexpected turn for his contemporaries in Berlin listening to Fichte for the first time, but should it be surprising for us, having at least since 2012 (the year the last volume of [Gesamtausgabe] appeared) access to all his published and unpublished works? I want to propose a way of reading Fichte, which bypasses two (...) popular and contradictory interpretations of his philosophy in the post-Jena period: (a) the Absolute is the new first principle (hence the I is just a shadow of the much higher being) and (b) his system basically remains unchanged (hence the being is nothing more than the I). At first, I analyze the functions of later Fichte’s improved version of the Kantian and Reinholdian abstract subject-object-symbolism and assign specific content to it. This will shed light on the structure and the first principle of the Doctrine of Science 1804/II. In the second section I give reasons why Fichte calls both God and I “absolute” and “pure being” and explain their relation to each other referring to a thought experiment sometimes used by Kant—an analogy between the divine and human (pure) reason. The analogical thinking of this kind remains within the borders of transcendental philosophy as long as it is used only for certain didactic purposes. (shrink)

This article aims to reconstruct the core thesis of Fichte’s theory of language, namely the antinomy of language. To answer the question, whether the language is the necessary condition of human being as rational entities, two approaches can be taken: the historical-empirical and the transcendental. The thesis asserts that language serves as the necessary mediation for thinking as well as freedom. Conversely, the antithesis highlights the limitations of the faculty of language and argues that the absence of language does (...) not alter the fact of the genesis of consciousness. The following research will show that the thesis and the antithesis are not contradictory, but rather two different perspectives that can be brought together to complete Fichte's transcendental philosophy. In the Foundations of Natural Right, Fichte attempts to deduce the reality of the concept of right by beginning with the act of self-positing. He understands right as a transcendental condition for the possibility of self-consciousness. According to Fichte, the concept of right should not be grounded in moral obligation but should instead be based on the relation between rational beings through mutual recognition. However, this deduction has often been criticized as unconvincing. This thesis seeks to defend (...) class='Hi'>Fichte’s position by reconstructing the steps of his argument. It argues that the concept of right, understood as a condition for self-consciousness, can be plausibly justified. To support this claim, the thesis analyzes a central concept in the deduction of right, namely the concept of summons. Through the summons, the subject becomes aware of itself. The thesis argues that the summons must possess both normative and causal dimensions in order to support the justification of the concept of right. (shrink)

The principal thesis in this review-essay is that the key linguistic terms in Fichte’s Wissenschaftslehre especially have two main meanings that appear at first sight to be almost in contradiction or opposed to each other. The reader of Fichte therefore has to work hard to overcome any apparent conflicts in the “double sense” of his philosophical terminology. Accordingly, I argue that Fichte’s linguistic method and use of language should be seen as part of his chief philosophical method (...) of synthesis, where we have to carry out a similar procedure and attempt to reconcile opposites using the power of the imagination. This thesis is put forward by means of a number of practical examples and in the context of some critical reflections on the recently published Cambridge Companion to Fichte, eds. ‘Facticity’ is a concept that classical phenomenologists like Heidegger use to denote the radically contingent or underivably brute conditions of intelligibility. Yet Fichte coins the term, to which he gives the opposing use of denoting unacceptably brute conditions of intelligibility. For him, radical contingency is a problem to be solved by deriving such conditions from reason. Heidegger rejects Fichte's recoil from facticity with his hermeneutics of facticity, supplanting Fichte's metaphor of our always being in reason's hand with (...) the metaphor of our always having been thrown. How does Heidegger inherit and diametrically repurpose Fichte's neologism? Whence the reversed meaning of ‘facticity’ in post-Kantian thought? The answer is Lask's doctoral thesis, which exerts an acknowledged impact on Heidegger's habilitation thesis. Lask interprets ‘facticity’ as Fichte's term for the individuality problem, that is, the resistance of the material particularity of individuals to explanation by the categories genetically deduced from reason. On his interpretation, ‘facticity’ denotes radical contingency in the guise of haecceity, that is, the brute uniqueness of individuals. Lask credits Fichte with registering the problem of individuality, which highlights the world's irreducibly precategorial character. But how is ‘facticity’ transmitted from Lask to Heidegger, given their opposing interpretations of how Fichte understands its meaning? I argue that (1) Lask misreads Fichte as a proponent of facticity, that is, one whose accommodation of radical contingency deflates the Wissenschaftslehre's systematic ambitions, and (2) Lask's misreading, without deceiving Heidegger regarding the sincerity of Fichte's ambitions, encourages Heidegger's own hermeneutics of facticity. One of the defining characteristics of Kant’s “critical philosophy” is what has been called the “critique of immediacy” or the rejection of the “myth of the given.” According to the Kantian position, no object can count as an object for a human knower apart from the knower’s own activity or spontaneity. That is, no object can count as an object for a human knower on the basis of the object’s givenness alone. But this gives rise to a problem: how is (...) it possible to accept the Kantian critique of immediacy while also giving an epistemologically adequate account of the constrained or finite character of human knowing (i.e., an account that does not rely on some appeal to what is simply “given”)? This paper examines how this crucial question is addressed (with more or less success) in the “critical philosophies” of Kant, Lonergan, and Fichte. (shrink)

The purpose of this book is both scholarly and polemical: the author seeks not only to render an accurate picture of Fichte and Hegel on the issue of intersubjectivity, but also to correct contemporary misconceptions which have led to the dismissal of German Idealism as abstract, rationalistic, and ahistorical.

It is well known that Kant seeks to discredit rational psychology on the grounds that we cannot access the nature of the soul by reflecting upon the ‘I think’ of self-consciousness. What is far less understood, however, is why Kant still believes the theorems of rational psychology are analytically true insofar as they represent the ‘I’ through the categories of substance, reality, unity, and existence. Early post-Kantian thinkers like Fichte would abandon this restriction and approach the concept of the (...) ‘I’ instead through the category of community or reciprocal interaction. The result was nothing less than a radical shift in thinking about persons after Kant, yet in a way that would bear a striking affinity to the substance monism of Spinoza. The aim of this chapter is to trace the origin of this shift and its aftermath in Fichte’s effort to defend a new conception of the ‘I’. (shrink)
