A critical Analysis of the Medical Malpractice laws in Nigeria (LLB Dissertation)

Medical malpractice is a serious menace being perpetuated on a daily basis in Nigeria; sadly the rate of reports or instituted action flowing from the above is very insignificant in comparison with the actual number of injured victims. This notwithstanding, the courts have tried in instances where they are opportune to award damages, both as compensation and as deterrent for other medical practitioners. While the burden of proof is on the claimant and discharged only in circumstances where only the defendant can give due explanations, this as well is impeded by the sacrosanct need for expert witnesses who are , unfortunately medical practitioners and who are in consequence in a mischievous habit of silence. Coupled with the fact that not all medical errors are actionable, the patient – victim’s rights in these circumstances would appear, if anything – fictitious. The recent effort by the federal government to mitigate this situation has as well, proven futile. This study would review these problems critically, focusing on statutory loopholes and would seek creative ways of solving them for greater efficiency in the health care system. This study employs a doctrinal, descriptive, analytical and comparative research approach, with the primary sources of data as statutes, case laws, conventions and treaties, whereas the secondary data would include textbooks, Newspapers, Journals, articles and online materials. The relevant laws were identified, analyzed and in appropriate cases compared with the laws in other jurisdictions, and in the end appropriate recommendations were given with a view to improve the position of the law in Nigeria.

The Jigawa Library Project
-
My name is Uche Osita and I am a Nigerian. I began the Jigawa library project in 2018 as a result of an urgent need to improve the standard of education in secondary schools in Jigawa State, Nigeria (Northern Nigeria).
The need arose from a research I conducted across the senior secondary schools in Jigawa which showed that only 4 out of 12 Government senior secondary schools had libraries that out of the three only one had up to date books and only two are in fact in use.
I…My name is Uche Osita and I am a Nigerian.
I have therefore began a state wide literacy campaign targeted at building, renovating and refurbishing libraries to meet up with the increasing need for quality education. The students in senior secondary schools are enthusiastic about learning but seem not to have the necessary materials to meet their undying thirst for knowledge.
I am working together with a team of two - Blessing Uche and Elizabeth Chinenye to spread the mass literacy campaign across Jigawa state.
Currently we have gone to over 8 schools in the state, gotten approval for the establishment, renovation and restocking of the school libraries.
We also aspire to create reading clubs in all the Senior Secondary Schools so as to provide a social structure for the libraries before they are completely set up.
We believe that education is greatly hindered without adequate access to books. We believe that access to essential books can open young minds to explore limitless potential. We are working hard to contribute to the Sustainable Development Goal No 4Other creatorsSee project
