Please read these Terms carefully. They form a binding legal agreement between you and Commodore International Corporation. If you do not agree, please do not use our website or place an order.
1. Who We Are
Commodore International Corporation (“Commodore,” “we,” “us,” or “our”) is a Delaware public benefit corporation with our principal place of business at 8 The Green, Suite A, Dover, DE 19901, USA. We design and sell computer hardware, consumer electronics (including mobile phones), software, and digital content to customers worldwide. EU VAT: NL828134996B01. UK VAT: GB504877573. The Commodore brand and associated trademarks are owned by Commodore Corporation B.V., a wholly owned subsidiary, and licensed to us for use in connection with our products and services.
2. Acceptance of These Terms
By visiting our website, creating an account, or placing an order, you agree to these Terms of Sale and Use (“Terms”), together with our Privacy Policy and Return Policy, all of which are incorporated by reference. If you do not agree, you may not use our website or Services. These Terms were last updated on April 24, 2026. We may update them from time to time.
If we make a material change (one that meaningfully affects your rights, how we process your data, or the fees you pay) we will give you reasonable advance notice by email or a prominent notice on our site, and where required by law, seek your renewed consent before the change takes effect. Your continued use of our website after any update constitutes acceptance of the revised Terms. The most current version is always available at the bottom of our website.
3. Eligibility
You must be at least 18 years old (or the applicable age of majority in your country) and capable of entering into a binding contract to use our website or place an order. By using our website you represent that you meet these requirements. We reserve the right to refuse or cancel orders at our discretion if we believe you do not meet them.
4. Account Security
Certain portions of our website or services may require you to create an account. You agree to provide accurate, current, and complete information when registering and to keep that information updated.
You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account. You agree to notify us promptly of any unauthorized access to or suspected misuse of your account.
Commodore is not liable for losses arising from unauthorized use of your account caused by your failure to safeguard your credentials.
5. Products and Services
We offer a range of hardware products (including computers, peripherals, and other electronic devices), merchandise, software, and digital downloads (collectively, the “Products”). Product descriptions, specifications, and images on our website are for informational purposes and are subject to change. We do our best to make sure everything is accurate, but unintentional errors may occur.
Certain Products may be unavailable for shipment to specific countries due to applicable export control laws, international sanctions, or local regulations. If your order is affected, we will notify you promptly and issue a full refund.
From time to time, Commodore may offer beta, preview, early-access, experimental, or limited-release Products, software, features, or services (“Beta Features”). Beta Features may contain bugs, interruptions, inaccuracies, or incomplete functionality and may be modified, suspended, or discontinued at any time without notice. Beta Features are provided “as is” and may not be subject to the same warranties, support commitments, or availability standards as fully released Products or services.
6. Vintage Manufacturing
Certain Commodore Products may be manufactured using restored, legacy, vintage, or historically authentic tooling, molds, production methods, or manufacturing equipment. As a result, Products may include minor cosmetic variations, tooling marks, surface irregularities, texture inconsistencies, mold lines, finish variation, or other visual characteristics that are inherent to the original manufacturing process.
These characteristics are considered intentional aspects of the Product’s authenticity and historical reproduction and do not constitute defects, damage, or nonconformity.
Products manufactured using vintage or original tooling remain covered by Commodore’s warranty for functional defects, material defects, shipping damage, or failures that impair intended use. However, minor cosmetic characteristics or imperfections resulting from the use of original or vintage manufacturing methods are not grounds for replacement, refund, or warranty claim unless prohibited by applicable law.
While Commodore may describe or intend a Product to be manufactured using vintage or original tooling, such tooling, molds, equipment, materials, or processes may become unavailable, impractical, damaged, exhausted, or commercially unreasonable to use. In such cases, Commodore reserves the right, at its sole discretion, to manufacture the Product using modern, replacement, re-created, or alternative tooling, molds, processes, materials, or methods that substantially preserve the intended design and functionality of the Product. Such substitution shall not constitute a defect, material change, breach, or grounds for cancellation, refund, replacement, or return.
Nothing in this section limits your statutory consumer rights that cannot be waived or excluded under applicable law.
7. Orders and Contract Formation
Placing an order on our website constitutes an offer to purchase. Our acceptance of your order is confirmed when we send you a written order confirmation by email, at which point a binding contract is formed between us.
We reserve the right to refuse or cancel any order, including after confirmation, if:
- a Product becomes unavailable or stock runs out;
- a pricing or description error is identified;
- we are unable to verify your payment or identity;
- the order involves a sanctioned country or end use; or
- we reasonably suspect fraud or misuse.
If we cancel an order you have already paid for, we will issue a prompt full refund to your original payment method.
We reserve the right to limit quantities, reject bulk purchases, or cancel orders that appear intended for unauthorized resale.
If you initiate a chargeback or payment dispute without first contacting us to seek resolution, we reserve the right to suspend fulfillment, cancel pending orders, disable account access, or refuse future purchases where permitted by law.
8. Pre-Orders
Certain Products may be offered on a preorder or backorder basis. Estimated shipping or release dates provided at checkout or elsewhere on our website are good-faith estimates only and are not guaranteed.
By placing a preorder, you acknowledge that the Product may not yet be manufactured, finalized, or available for immediate shipment; estimated release or shipment dates may change; manufacturing schedules, component availability, customs delays, or supply chain constraints may affect delivery timing; payment may be collected at the time of preorder or at another time disclosed during checkout; and features, specifications, packaging, or bundled items may change before shipment.
You may cancel a preorder before shipment unless the Product page expressly states otherwise or unless production, customization, limited-run manufacturing, or other disclosed circumstances make the preorder non-cancellable under applicable law. Notwithstanding the foregoing, EU and UK customers retain their statutory cancellation rights and any non-cancellable designation applies only to the extent permitted by mandatory local consumer protection law. If Commodore cancels a preorder, you will receive a full refund of amounts paid.
Preorder fulfillment may occur in batches, production waves, or geographic allocation groups. Placement of a preorder does not guarantee shipment within a specific production batch unless expressly stated.
In addition to the foregoing, by placing a preorder for any Product, you expressly acknowledge and agree that:
- any stated shipping or release date is an estimate only and delays may occur;
- preorder Products may be subject to manufacturing, component, regulatory, customs, tariff, freight, or supply-chain delays outside Commodore’s control;
- you may cancel your preorder before shipment for a refund of amounts paid, less any non-refundable payment processing fees where permitted by applicable law and disclosed at checkout (for the avoidance of doubt, EU and UK customers exercising their statutory right to cancel within the 14-day cooling-off period will receive a full refund of amounts paid without any deduction);
- Commodore may cancel, suspend, delay, modify, or refund a preorder at any time before shipment if necessary due to inventory limitations, manufacturing changes, regulatory
issues, pricing errors, tariffs, supply chain disruption, fraud concerns, or other business or legal considerations; - features, packaging, bundled accessories, specifications, cosmetic finishes, firmware, software functionality, and included content may change between preorder and shipment;
- tariffs, duties, import charges, or similar governmental fees imposed after purchase may increase the total cost of delivery for international orders where permitted by law;
- you have reviewed any preorder FAQs, shipping disclosures, or preorder-specific information displayed on the applicable Product page; and
- by completing checkout for a preorder Product, you agree that these preorder-specific disclosures form part of these Terms and are incorporated into your purchase agreement.
9. Prices, Taxes, and Import Fees
All prices are displayed in U.S. dollars (USD) unless otherwise stated at checkout. Prices are subject to change at any time before your order is confirmed. Once we send you an order confirmation, the price is locked in.
Depending on where you live, additional charges may apply. Sales tax or VAT may be calculated and collected at checkout where required. Customs duties, import fees, or local taxes in your destination country are your responsibility unless we expressly state otherwise. Such other fees may be added to the price and collected at the time of payment.
We make every reasonable effort to display estimated additional costs before you complete your purchase. If you are in the EU, the price shown at checkout is the final price inclusive of applicable VAT.
10. Payment
We accept major credit and debit cards (Visa, Mastercard, American Express), PayPal, Apple Pay, Google Pay, and any other methods listed at checkout. All transactions are processed securely through trusted payment providers. We do not store your full card number on our systems.
If your payment fails or is later charged back, we reserve the right to suspend or cancel the related order. You remain responsible for any amounts owed.
11. Shipping and Delivery
Estimated delivery times are provided at checkout and are good-faith estimates, not guarantees. Actual delivery may vary due to carrier delays, customs processing, or circumstances beyond our control.
Risk of loss and title to hardware Products transfer to you when the carrier first attempts delivery to your shipping address. We are not responsible for delays or losses attributable to the carrier after handoff, but we will work with you in good faith to resolve any issue.
For international orders, you are responsible for compliance with your country’s import rules, including providing accurate customs information.
12. Returns, Cancellations, and Refunds
Our Return Policy is set out in a separate document available at the bottom of our website and is incorporated into these Terms by reference.
Key highlights:
- Hardware: return within 14 days of delivery in unused, original condition for a full product refund (outbound shipping not refunded).
- EU and UK customers: you have the statutory right to cancel your hardware order within 14 days of delivery under the EU Consumer Rights Directive (2011/83/EU) and the UK Consumer Rights Act 2015.
- Digital downloads and software: once a download begins, you waive your EU/UK cancellation right under Art. 16(m) of EU Directive 2011/83/EU. If a product is defective, our warranty provisions apply regardless.
- Other consumer electronics: subject to the same 14-day return window.
13. Warranty
Every Commodore hardware Product comes with a 1-year limited warranty against defects in materials and workmanship. This warranty does not cover damage caused by accident, misuse, unauthorized modification, or normal wear and tear, and is explained in further detail on our website or as provided with your product. In addition to our limited warranty, your statutory consumer rights apply in full, including, but not necessarily limited to:
- EU: 2-year legal guarantee under the Sale of Goods Directive (2019/771/EU).
- UK: rights under the Consumer Rights Act 2015.
- Australia: rights under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010).
- Other jurisdictions: any mandatory consumer protections in your country of residence.
These statutory rights are in addition to, and not in place of, our limited warranty. Nothing in these Terms limits or excludes rights you have under applicable consumer protection law that cannot be excluded or limited by contract.
Extended warranty options may be available for purchase for certain Products in our store.
14. Software Licenses and Digital Downloads
When you purchase software or a digital download from us, we grant you a limited, non-exclusive, non-transferable license to use that software or content for your personal, non-commercial use, unless the product page states otherwise. You do not acquire ownership of the software or content.
You may not copy, reproduce, redistribute, or sublicense the software beyond what is permitted by applicable law; reverse-engineer, decompile, or disassemble the software, except to the extent permitted by law (including Art. 6 of the EU Software Directive 2009/24/EC and equivalent provisions); remove or alter any copyright, trademark, or other proprietary notices; or use the software for commercial purposes without our written permission.
If we discontinue a digital product, we will endeavor to give reasonable notice and provide a reasonable remedy (such as a download archive or refund).
Certain Products may rely on firmware, software, cloud functionality, online services, or third-party integrations. We may release updates, patches, bug fixes, security updates, feature enhancements, or modifications from time to time.
You acknowledge that software or firmware functionality may evolve over time; certain features may be added, modified, restricted, or discontinued; updates may be required to maintain security, compatibility, or functionality; some features may depend on third-party services outside our control; and compatibility with older hardware, operating systems, peripherals, or third-party services may change over time, including being removed entirely.
We are not responsible for third-party platform changes that affect compatibility or functionality.
15. Intellectual Property
The Commodore name, logo, and related trademarks and trade dress (collectively, the “Commodore Marks”) are owned by Commodore Corporation B.V., a wholly owned subsidiary of Commodore International Corporation, and are used by Commodore International Corporation under license. All content on our website (including product designs, photographs, software, logos, trademarks, and written content) is owned by Commodore or our licensors and is protected by applicable intellectual property laws. Unauthorized copying, reproduction, or use is prohibited.
If you wish to license our brand or use our content, please contact us. We are happy to discuss reasonable arrangements.
Our trademarks (including the Commodore name and logo) may not be used in any manner that is likely to cause confusion, disparage us, or misrepresent our products.
16. DMCA/Copyright Policy
We respect the intellectual property rights of others and expect users of our website and services to do the same.
If you believe content available through our website infringes your copyright, you may submit a notice to our designated copyright agent containing:
- identification of the copyrighted work claimed to be infringed;
- identification of the allegedly infringing material and its location;
- your contact information;
- a statement that you have a good-faith belief the use is unauthorized;
- a statement, under penalty of perjury, that the information provided is accurate and that you are authorized to act on behalf of the copyright owner; and
- your physical or electronic signature.
We may remove or disable access to allegedly infringing content and may terminate repeat infringers where appropriate.

17. Reviews, Comments, and User Content
We genuinely value your feedback. If you submit a review, comment, photo, or other content to us or on our website, you grant us a non-exclusive, royalty-free, irrevocable, perpetual, sublicensable, worldwide license to display, reproduce, and use that content in connection with our business (for example, on our website, in marketing materials, or on social media).
By submitting content, you confirm that you own it or have the right to share it, and that it does not infringe any third party’s rights. You can withdraw consent for promotional use at any time by contacting us; this does not affect our right to display legitimate product reviews.
18. Unsolicited Ideas and Proposals
We love the creativity and passion of the Commodore community. However, to avoid misunderstandings, Commodore does not accept unsolicited confidential ideas, proposals, product concepts, suggestions, designs, feature requests, business plans, or other materials.
Any unsolicited submission you send to us will be treated as non-confidential and non-proprietary.
By submitting ideas or proposals, you acknowledge that Commodore may already be developing similar concepts independently and that your submission does not create any obligation of confidentiality, compensation, or attribution. You further grant Commodore a perpetual, irrevocable, worldwide, royalty-free license to use and exploit such submissions for any purpose.
You represent that you have the right to provide such submission and grant these rights.
19. Prohibited Uses
When using our website and Products, you agree not to use automated bots, scrapers, or crawlers to extract data from our website; reverse-engineer, tamper with, or attempt to circumvent security measures on any Commodore hardware or software; use our Products or website for any illegal purpose, including violation of export controls or sanctions; infringe the intellectual property rights of Commodore or any third party; harass, defraud, or harm us, other customers, or third parties; submit false or misleading information in connection with an order, return, or warranty claim; circumvent or manipulate our billing systems; or engage in any conduct that could damage our reputation or the security or integrity of our website.
20. Third-Party Links and Services
Our website may contain links to third-party websites or services. These are provided for convenience only. We do not control, endorse, or take responsibility for any third-party content, products, or practices. Your use of third-party websites is at your own risk and subject to those websites’ own terms and policies.
21. Force Majeure
Commodore will not be liable for any delay, interruption, or failure to perform any obligation under these Terms where such delay or failure results from events beyond our reasonable control, including but not limited to acts of God, natural disasters, flood, fire, pandemic, epidemic, war, terrorism, civil unrest, labor disputes, governmental action including the imposition of tariffs or import controls, embargoes, customs delays, telecommunications failures, cyberattacks, shortages of materials or components, carrier disruptions, power outages, or failures of third-party suppliers or service providers.
If such an event materially affects our ability to fulfill an order or provide a Product or service, we may delay performance, suspend obligations for the duration of the event, or cancel the affected order and issue an appropriate refund where required.
22. Disclaimer of Warranties
To the maximum extent permitted by applicable law, our website and its content are provided “as is” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our website will be error-free, uninterrupted, or free of viruses or harmful components.
These disclaimers do not apply to the extent prohibited by consumer protection laws in your jurisdiction, including mandatory warranty rights under EU, UK, and Australian law.
23. Limitation of Liability
To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to these Terms or our Products shall be limited to the greater of the amount you paid for the Product giving rise to the claim; or USD $100.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost data, lost profits, or business interruption, even if we were advised of the possibility of such damages.
Nothing in this section limits our liability for death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; any liability that cannot be limited or excluded under applicable mandatory consumer protection law; or a breach of any mandatory statutory right (for example, your right to goods of satisfactory quality under UK or EU law).
24. Indemnification
To the maximum extent legally permissible in your jurisdiction, you agree to indemnify, defend, and hold harmless Commodore and its officers, directors, employees, and agents from and against any claims, losses, damages, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms; your violation of any applicable law or third-party right; or information you submit to us.
This indemnification obligation does not apply in jurisdictions where such obligations are not enforceable against consumers.
25. Compliance with Laws
You are responsible for complying with all laws applicable to your use of our Products and website, including U.S. export control laws (EAR, ITAR), OFAC sanctions regulations, and local laws in your country. You represent that you are not located in, or purchasing on behalf of a party in, a country subject to a comprehensive U.S. embargo, and that you are not on any denied-party list. You represent that Products will not be exported, re-exported, transferred, or used in violation of applicable export control laws.
26. Dispute Resolution
a. Informal Resolution. If something goes wrong, please contact us first. We genuinely want to resolve issues quickly and fairly. We ask that you give us up to 30 days to respond before initiating any formal proceeding
b. Binding Arbitration. If we are unable to resolve a dispute informally, and if the law of your country permits arbitration of such disputes, you and Commodore agree that the dispute will be finally resolved by binding arbitration administered by the International Centre for Dispute Resolution (ICDR) in London, United Kingdom, conducted in English, pursuant to the ICDR International Arbitration Rules and, where applicable, the U.S. Federal Arbitration Act. The arbitrator’s decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction. If the mandatory consumer protection laws of your country do not permit arbitration of this dispute, or require you to bring your claim in your local courts, those laws control and you may bring your claim accordingly. Nothing in this section is intended to deprive you of rights you cannot waive under applicable consumer law
c. EU customers may use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
d. UK customers may contact the Citizens Advice consumer service or eligible Alternative Dispute Resolution schemes.
e. Class Action Waiver. To the fullest extent permitted by law, you and Commodore each agree that any dispute resolution proceeding will be conducted only on an individual basis and not as a class, collective, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration. This waiver does not apply where it is prohibited by mandatory applicable law.
f. Small Claims. Either party may bring an individual claim in a small claims court (or equivalent local tribunal) if the claim qualifies.
g. Injunctive Relief. Notwithstanding any arbitration or dispute resolution provision in these Terms, Commodore may seek injunctive relief, temporary restraining orders, or other equitable remedies in any court of competent jurisdiction to protect its intellectual property, confidential information, trademarks, trade secrets, website integrity, or other proprietary rights.
27. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law principles, except that mandatory consumer protection provisions of your country of residence will continue to apply where they cannot be excluded by contract.
28. Marketing Communications
We only send marketing emails with your consent. Every marketing message includes a one-click unsubscribe link. Transactional and order-related emails are not subject to the marketing opt-out. For details on how we use your data, see our Privacy Policy.
29. Changes to Our Products and Services
We may modify, update, or discontinue Products, features, or our website at any time at our sole discretion. If we discontinue a Product you have already paid for but not yet received, we will issue a full refund. We will not be liable for any modification or discontinuation of Products or features beyond that.
30. Termination
We may suspend or terminate your access to our website or any account if you breach these Terms or if we are required to do so by law. We will endeavor to give advance notice where feasible. The sections titled Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Dispute Resolution survive termination.
31. Severability and Entire Agreement
If any provision of these Terms is found invalid, illegal, or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the rest of the Terms will continue in full force. These Terms (together with the Privacy Policy and Return Policy) constitute the entire agreement between you and Commodore regarding your use of our website and purchase of Products, and supersede all prior agreements on those subjects.
32. Miscellaneous
You may not assign your rights or obligations under these Terms to any third party without our prior written consent. We may assign our rights and obligations at any time, including in connection with a merger, acquisition, or asset sale.
Our failure to enforce any right under these Terms does not constitute a waiver of that right. A written waiver of any right is effective only with respect to the specific instance and purpose for which it was granted.
These Terms do not create any partnership, agency, or employment relationship between you and Commodore.
Except as expressly granted in these Terms, Commodore reserves all rights, title, and interest in and to its Products, software, website, intellectual property, trademarks, content, and services.
