The question is whether this language prevents a court from referring the matter to
DHCR.
The 'Am I Eligible' application includes a series of questions to be answered before generating the results, and representatives from
DHCR's licensing department will be at hand during the exhibition to provide assistance and explain how the application works.
Rent overcharge disputes fall under the jurisdiction of both the Supreme Court and the
DHCR but since November of last year, judges in Manhattan and Brooklyn have consistently deferred these types of cases to the state's agency.
