As noted, the original version of the statute required
subcontractors to furnish payroll information "upon request." For any contract entered into on or after January 1, 2019, however, a contractor may not withhold payments as "disputed" for failing to provide this information unless the contract between the direct contractor and its
subcontractor identifies the specific documents and information that the direct contractor will require a
subcontractor to provide.
As of May 2, Tarraf still owes the
subcontractor $32,678 on that contract, the lawsuit said.
As the above amply illustrates, the determination of whether a party is a
subcontractor or materials supplier for purposes of a claim on a Miller Act payment bond is a complicated and fact-intensive one.
The recent purge of job
subcontractors in the country has seen 4,580 companies downsized to 2,669 when the Department Order (DO) 18-A Rules and Regulations on Contracting was enacted, and out of those, only 1,911 have successfully acquired the DO 174-17 Certification as of June 2018.

Subcontractor mobilized onto the site and commenced its scope of work, it issued its first interim payment application to the Main Contractor who did not settle this payment because it had not received the equivalent payment from the Employer.

subcontractor relates to the activities of its employees rather than a rogue act by an unknown third-party hacker.
